US Court Blocks Trump's Citizenship Order, Bringing Relief to Indians

US federal court in Seattle has blocked former President Donald Trump’s executive order that aimed to end birthright citizenship. This decision brings major relief to Indian immigrants, especially those on H-1B, L-1, H-4, and F-1 visas, who feared their children would lose US citizenship rights.

What Was Trump’s Order?

Trump signed an executive order on January 20, 2025, after beginning his second term as President. The order denied automatic US citizenship to children born to non-permanent residents, meaning children of visa holders would no longer be recognized as US citizens.

Why Did the Court Block It?

Judge John Coughenour, ruling on the case, said the US Constitution protects birthright citizenship, and any change must go through an amendment, not just a presidential order.

"The rule of law is not a tool for political games. If the government wants to change birthright citizenship, it must amend the Constitution," he stated.

A similar ruling was also given by Judge Deborah Boardman in Maryland, strengthening legal opposition to Trump's policy.

How Does This Affect Indian Families?

Had Trump’s order taken effect, it would have caused severe problems for many Indian families:

  • Children born in the US to visa holders (H-1B, H-4, L-1, F-1) would not be granted US citizenship.
  • They could lose access to in-state tuition, financial aid, and scholarships.
  • Those stuck in green card backlogs could face deportation at 21.
  • Many expectant Indian parents rushed to deliver babies before the February 20 deadline.

What Happens Next?

The Justice Department plans to appeal the ruling, taking it to the 9th US Circuit Court of Appeals. If challenged further, the case could reach the US Supreme Court.

For now, Indian families and other immigrant communities can feel relieved, as the courts have temporarily protected birthright citizenship.
